These Terms & Conditions ("Terms") govern your use of communications services offered by Texas Roof Guardians ("Texas Roof Guardians," "we," "us," or "our"), including text messages (SMS/MMS), phone calls, and email sent using contact information you provide to us through our website, online forms, in person, by phone, or through a referral. By providing your phone number or email address and/or by opting in to messaging, you agree to these Terms and to our Privacy Policy.

1. Acceptance of these Terms

By submitting a contact form, requesting an inspection, enrolling in a program, checking an opt-in box, replying to a confirmation message, or otherwise providing your contact information to us, you confirm that:

  • You are at least 18 years old and a U.S. resident.
  • The phone number and email address you provided belong to you, or you are authorized to provide them and to receive communications at them.
  • You agree to receive communications from us as described below.
  • You have read and agree to our Privacy Policy.

2. Consent to be contacted

When you provide your contact information to Texas Roof Guardians, you expressly consent to be contacted by us and our authorized representatives at the phone numbers and email addresses you provided, including by:

  • Live agent phone calls;
  • Automated or prerecorded voice messages;
  • Transactional and informational SMS or MMS text messages; and
  • Email.

These communications may relate to your inquiry, scheduled inspections, project updates, estimates, invoices, insurance-claim coordination, the Storm Protection Plan, warranty service, customer-care follow-up, and other service-related matters. Consent to receive marketing or promotional text messages is not a condition of purchasing any goods or services from us.

3. SMS / text messaging program (A2P 10DLC)

Our text-messaging program is registered as an Application-to-Person (A2P) 10DLC program with U.S. wireless carriers and is delivered through a licensed messaging provider (such as Twilio). The following terms apply to all SMS and MMS messages exchanged with Texas Roof Guardians.

3.1 Program description

Texas Roof Guardians sends customer-care, appointment, project-status, claim-status, payment, and account-related text messages, and may occasionally send promotional messages about roofing, storm response, and the Storm Protection Plan to customers and leads who have opted in.

3.2 How you opt in

You opt in to receive text messages by any of the following:

  • Submitting a form on our website that includes an SMS opt-in checkbox or disclosure;
  • Texting our number first or replying to a confirmation message with YES, START, or a similar affirmative keyword;
  • Verbally agreeing to receive text messages during a phone call with our team and having that consent logged in our system; or
  • Signing a service agreement, enrollment form, or proposal that includes a text-messaging consent disclosure.

3.3 Message frequency

Message frequency varies based on your interactions with us and the stage of your project. You may receive messages in response to your requests (such as scheduling), during active projects (such as crew arrival or completion updates), and periodically for service or care reminders.

3.4 Message and data rates

Message and data rates may apply. Texas Roof Guardians does not charge a fee to send or receive text messages, but your wireless carrier may charge you for messages depending on your plan. Contact your carrier with questions about your plan.

3.5 Opt out — reply STOP

You can opt out of text messages at any time. Reply STOP to any text message from us to unsubscribe. After you send STOP, we will send one final message confirming that you have opted out, and you will not receive any additional text messages from that program unless you opt in again. You may also opt out by emailing info@txroofguardians.com or calling 830-228-6123.

3.6 Help — reply HELP

For help, reply HELP to any text message from us, email info@txroofguardians.com, or call 830-228-6123. We will respond with our company name and contact information.

3.7 Supported carriers

Our messages are compatible with major U.S. carriers including AT&T, Verizon, T-Mobile, US Cellular, and most regional carriers. Carriers are not liable for delayed or undelivered messages.

3.8 No third-party sharing of mobile information

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Mobile opt-in data and consent are not shared, sold, rented, or leased to any third party. We only share mobile information with service providers (such as our messaging platform and CRM) that help us operate the messaging program, and only to the extent necessary to deliver the service.

4. Phone calls and call recording

By providing your phone number, you consent to receive phone calls from Texas Roof Guardians and our representatives, including calls made using an automatic telephone dialing system or an artificial or prerecorded voice. Some calls may be recorded or monitored for quality assurance, training, dispute resolution, and compliance purposes. If you do not want to be recorded, please notify the agent at the start of the call.

5. Email communications

By providing your email address, you consent to receive transactional and service-related emails from us (such as estimates, contracts, scheduling, invoices, receipts, and claim updates). Marketing or newsletter emails are sent only if you have opted in or have an existing customer relationship with us, and every marketing email contains an unsubscribe link.

6. Accuracy of your information

You are responsible for providing accurate contact information and for updating it if it changes. If you give up a phone number or email address that you previously provided to us, you must notify us so we can stop contacting that number or address. Until you notify us, you remain responsible for any communications sent to the information on file.

7. Acceptable use

You agree not to use our communications channels to (a) send unlawful, abusive, threatening, harassing, or harmful content; (b) impersonate any person; (c) interfere with or disrupt our systems; or (d) violate any applicable law or regulation. We reserve the right to refuse service, block, or terminate communications with anyone who violates these Terms.

8. Disclaimers

Communications and the Services are provided on an "as is" and "as available" basis. We do not guarantee that any message will be delivered, that delivery will be timely, or that messages will be free of errors or interruptions. To the maximum extent permitted by law, Texas Roof Guardians disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the maximum extent permitted by law, Texas Roof Guardians and its officers, directors, employees, agents, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of, or inability to use, the communications services described in these Terms — even if we have been advised of the possibility of such damages. Nothing in these Terms limits liability that cannot be limited under applicable law.

10. Indemnification

You agree to indemnify and hold Texas Roof Guardians harmless from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from (a) your provision of contact information that you were not authorized to share, (b) your violation of these Terms, or (c) your violation of any applicable law or the rights of any third party.

11. Privacy

Our collection, use, and protection of your personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy describes the categories of information we collect, the limited circumstances in which we share information with service providers, and how you can exercise your rights with respect to your information.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Effective" date at the top of this page. Material changes that affect how we contact you will, where required by law, be communicated to you separately. Your continued interaction with us after the changes take effect constitutes your acceptance of the updated Terms.

13. Governing law and venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or related to these Terms or our communications with you will be brought exclusively in the state or federal courts located in Bexar County, Texas, and you consent to the personal jurisdiction of those courts.
